writing in 523 in a distant country estates in Pavia, 450romanMiles from Rome, (later) capital (540-553 one of the last centers of Ostrogothic resistence to the East) of the Ostrogothic kingdom (493-553) established by Theodoric (454-526) when he defeated his rival Odoacer at a banquet. During the instability that followed Theodoric, Justinian waged war (the Gothic War) for 21 years starting 535 causing much damage in Italy. Any remaining Ostrogoths absorbed into the Lombard Kingdom established 568.

The primary sources are in general agreement over the facts of what happened. At a meeting of the Royal Council in Verona, the referendarius Cyprianus accused the ex-consul Albinus of treasonous correspondence with Justin I. Boethius leapt to his defense, crying, "The charge of Cyprianus is false, but if Albinus did that, so also have I and the whole senate with one accord done it; it is false, my Lord King."

Cyprianus then also accused Boethius of the same crime and produced three men who claimed they had witnessed the crime. Boethius and Basilius were arrested.
