Usually when a president mobilizes the national guard, it's when a governor asks him to. This time the police said they were getting it under control and the governor opposed Trump's action.
Newsom is (probably) going to say Trump is restricting state sovereignty as under Amendment 10.
President might say he was acting under the Insurrection Act. Does it qualify as an insurrection? Even if it doesn't, does the Act give the president authority to do this anyway.
If Trump said yeah we're doing Insurrection Act, it would allow the National Guard to act as domestic law enforcement, to do much more, not just be support for traditional law enforcement, but they could do search and seizure and arrest.
What is protest and what is insurrection? Some say protest is American. Insurrection could also be considered to be American.
