The Quebec supreme court stuck the manditory minimum, continuing the trend, for CP. It violated Sec 1 of the Charter, because mandatory minimums cover a broad range of facts and scenarios, and leaves no choice but to impose a grossly disproportionate sentence on some offenders. In some cases, it constitutes cruel and unusual punishment.

In the case, an 18 year old received a nude image of a 17 year old, without asking for it, and from a third person, and didn't delete it and did access it.

Judges should be free to decide appropriate or just sentences, they argue. Sentencing should not be done by politicians, in any shape or form, because politicians are motivated by political interests based upon opinions of a public that is not informed, partially because our ‘legacy media’ spews bs. ...
